* A) Approval of Order Making Appointments. (Appointments have been posted and advertised. Interviews were conducted as set forth in the Denton County policies adopted by the Commissioners Court, except as otherwise stated in the appointment orders. These appointments are within the budgetary constraints.)

A) Approve to call a public hearing on September 12, 2006, at 9:30 a.m. to consider the County Clerk’s Record Management fund, fee and plan, and any appropriate action.

B) Approve to call a public hearing on September 12, 2006, at 9:40 a.m. to consider the County Clerk’s Record Archive fund, fee and plan, and any appropriate action.

12. SHERIFF

* A) Approval of Addendum #4 to Food Service Contract with Mid-America, and any appropriate action. (Briefing 8-22-06)

* B) Approval of Factory/Field Change Order Authorization in the additional amount of $5,080 between Harris Corp. and Denton County for the Microwave Radio System, and any appropriate action. (Briefing 8-22-06)

* A) Approval of Building Usage Request for the Sandy Jacobs Government Center Community Center for Girl Scout Troop 452 Meetings from 6 pm to 8 pm on Sept. 25, Oct. 2, Nov. 27, Dec. 4, Dec. 18, 2005 and Jan. 8, Jan. 11, Feb. 5, Feb. 19, March 5, April 2, April 16, April 30, May 14, 2006, and any appropriate action. * B) Approve the Agreement between the City of Denton and Denton County, Texas Providing for Payment and Use of Hotel Tax Funds for the Courthouse-on-the-Square Museum, the Bayless-Selby House Museum, and the Denton County African American Museum in the amount of $99,250, and any appropriate action. C) Approval of the Interlocal Cooperation Agreement between Denton County and Wise County to maintain those roads which fall along the county line, and any appropriate action. Commissioner, Precinct #1

F) Approval of the re-appointment of Bernie Francis to the North Central Texas Workforce Development Board, and any appropriate action. County Judge

14. LEGAL

A) Any appropriate action on Executive Session matters - Legal Department.

B) Approval of the Memorandum of Agreement (MOA) between Denton County and the North Central Texas Council of Governments (NCTCOG)/Regional Transportation Council (RTC), the subject Memorandum of Agreement sets forth the funding strategy for the project consisting of improvements to IH-35E from the President George Bush Turnpike to North of FM 407 in Denton County, Texas, Denton County’s funding commitment to the project is $57 million, and any appropriate action.

C) Approval of (1) the Real Estate Contract between Denton County and The Property Owner’s Association of Sunrise Bay, for the purchase of permanent drainage easement for the Lake Lewisville Corridor Project, Section 3; (2) authorization to proceed with the closing and approval for the County Judge to sign all necessary closing documents to purchase the property from The Property Owner’s Association of Sunrise Bay; and (3) direction to the County Auditor to issue a warrant in the amount of the purchase price plus any fees for the purchase of the permanent drainage easement from The Property Owner’s Association of Sunrise Bay, with funding to come from the Lake Lewisville Corridor Project, Auditor #7401, Commissioner Precinct #1, and any appropriate action.

D) Approval of (1) the Real Estate Contract between Denton County and Diana Hellickson and husband, Dean Hellickson; and Eric Vargus and wife, Karen Vargus, for the purchase of permanent drainage easement for the Lake Lewisville Corridor Project, Section 3; (2) authorization to proceed with the closing and approval for the County Judge to sign all necessary closing documents to purchase the property from and Diana Hellickson and husband, Dean Hellickson; and Eric Vargus and wife, Karen Vargus; and (3) direction to the County Auditor to issue a warrant in the amount of the purchase price plus any fees for the purchase of the permanent drainage easement from Diana Hellickson and husband, Dean Hellickson; and Eric Vargus and wife, Karen Vargus, with funding to come from the Lake Lewisville Corridor Project, Auditor #7401, Commissioner Precinct #1, and any appropriate action.

E) Approval and acceptance of a Performance Bond, Payment Bond and Maintenance Bond for paving improvements by Austin Bridge and Road L.P., made payable to Denton County, Texas, in the amount of $277,427.70; and approval and acceptance of a Performance Bond and Payment Bond for drainage improvements by Murray Construction Company, Inc., made payable to Denton County, Texas, in the amount of $59,882.00 and any appropriate action. All bonds are paving and drainage improvements shall serve Liberty Crossing Addition located in the extraterritorial jurisdiction of Bartonville, Denton County, Texas, Commissioner, Precinct #1.

15. EXECUTIVE SESSION

The Commissioners Court reserves the right to exercise its discretion and may convene in executive session as authorized by the Texas Government Code §551.071, et seq. on any of the agenda items.
