Be it remembered, Commissioners Court of Denton County, Texas was called to order on the 17th day of August, 2004, at 9:00 a.m. in Commissioners Courtroom, 2nd Floor, Courthouse on the Square, Denton, Texas by Denton County Judge Mary Horn. Commissioners Jim Carter, Bobbie J. Mitchell and Cynthia White were present, along with County Clerk Cynthia Mitchell’s representative, Senior Administrator to Commissioners Court, Kathleen Bransford.
Court opened with an Invocation by Steve Mossman, Tax Assessor/Collector, followed by the Pledges of Allegiance to the American and Texas Flags led by Donna Stewart, Budget Director.
Mr. Mossman: Father, thank You this morning for the benefits we have in this country, for the beauty, the creation that You have given to us. And we pray now, Father, that You would protect the affairs of this Court this day for You are the glory and our peace. In Jesus' name, Amen.

AMUBLANCE FUNDING
Ms. Stewart, Budget Director: We have a few items we need to discuss today. Item 4 was removed at the request of the department. The first item is to discuss Ambulance Funding which has been discussed a couple of times. The Changes Sheet has been updated and has a few revisions. Jody Gonzalez, Fire Marshal, is proposing the second option as seen at the top of Page 1 of 9 of the Changes Sheet; that is to reduce county-wide Ambulance Funding by $45,000, offsetting the ambulance revenue for a 0 impact to the budget while allowing all outside entities to bill Medicaid/Medicare.
Judge Horn: I spoke to Jody after court last week. The solution now is a 0 impact as opposed to our discussions previously in which it would have had an impact. This allows these jurisdictions to derive more benefit from Medicare/Medicaid without the county involving ourselves in the process.
Comm. Carter: You have discussed this with the various municipalities and they are in agreement?
Mr. Gonzalez: Yes sir.

FIXED CAR ALLOWANCES
Ms. Stewart: Comm. Mitchell had asked our office to work up some scenarios for Fixed-Car Allowances. We provided you back-up information, as well, under R-67. The first scenario provides for a $100 per month increase excluding Elected Officials. I need to make you aware of an error on our Spreadsheet. Page R-68 shows an increase for the Criminal District Attorney and that should not be in there. So the Total Fixed/Reimbursable & Benefits bottom line impact should be $61,590, not the $62,990 that is reflected. That same error exists on the second scenario with the $200/month increase so the bottom line should be changed from $125,979 to $123,180. Also plugged into these scenarios is an increase for the Elected Officials whom were excluded from the original motion, affecting four: County Clerk, District Clerk, Criminal DA and the County Treasurer. The impact for that would be $67,189 on the first scenario; for the second scenario, the impact would be $134,378.
Comm. Mitchell: To keep from raising the taxes anymore, I had suggested that we take this out of our Unappropriated Contingency or our Fund Balance as a one time hit, if you are interested.
Judge Horn: How does this compare to other counties?
Ms. Stewart: We had that information in the packet last week for some of the positions. There were several positions that were not addressed in those scenarios which is why, I believe, Comm. Mitchell wanted to bring this forward so all would be considered. If court is interested, we would need to know from where you want these funds pulled – either Unappropriated Contingency or Fund Balance.
Judge Horn: I’m pretty protective of the Fund Balance.
Comm. Mitchell: I know you are….but I believe we have a considerable amount built up with the tax increase providing an additional $375,000. I am willing to sacrifice my “sacred cow” – Unappropriated Contingency…..
Ms. Stewart: $375,000 is correct.
Comm. White: I wouldn’t have a problem with it coming from Unappropriated Contingency if we are looking at Option One for $100/month increase.
Comm. Mitchell: My preference is the $200/month because they have not had an increase in a long time, but I am not opposed to the $100/month.
Comm. Carter: I can support the $100/month which is what I suggested at one time. My preference is to use the Fund Balance. Either way we go, the Fund Balance is going to reflect it next year. If the Unappropriated Contingency runs low, we will still have to pull from the Fund Balance anyway. There is really no net affect either way.
Comm. White: I believe the Fund Balance is important as evidenced by our meeting with the folks in New York. To clarify, discounting our actions up to now, isn’t the Fund Balance increasing significantly?
Judge Horn: It needed to, Commissioner.
Comm. White: Well, of course it did, but has that really been mentioned? What was it then and now? I think it went to 15 million, which it needed to….
James Wells, County Auditor: The total county-wide ending Fund Balance projected is right at 16 million – that’s General Fund and all other funds. The General Fund is projected at 10 million, we expect that to be higher. It has been as low as 4 million. This year we’re projecting it to increase from 5 to 10 million.
Judge Horn: Donna, what is Unappropriated Contingency set at this time after all recent adjustments?
Ms. Stewart: Our Regular U.C. is at $800,000 for next year.
Judge Horn: Primarily that has been drawn down by housing inmates out of county and court appointed attorneys – the two big hits, anyway.
Comm. White: We have contingency set aside for those two…
Ms. Stewart: Yes, we do. You’re exactly right. We have $100,000 in the budget for housing inmates out of county, $500,000 for Worker’s Comp Contingency and $390,000 for Court Appointed Attorneys. On Court Ordered, let me remind you that we significantly increased the individual budgets for the district court level departments.
Comm. White: I’d rather see it come out of Contingency.
Judge Horn: I would too.
Comm. Carter: Let’s ask the Auditor which is best.
Mr. Wells: I agree with the comment that at the end of the year it is a wash…it doesn’t matter.7. B-2) Move to approve Scenario One, $100 per month increase for Elected Officials - not previously approved - Department Heads, and Employees using Fixed Car Allowances, for an impact of $67,189 from Unappropriated Contingency by Comm. ELECTIONS ADMINISTRATOR
Ms. Stewart: Next item deals with the Elections Administrator position. Yesterday a meeting was held of the Elections Commission with action taken regarding the car allowance for the Elections Administrator. Page A-141 is a Budget Impact Statement reflecting an impact of $2,500 to increase his fixed car allowance from $5,000 to $7,135.
Judge Horn: I knew that bringing this issue to court without a vote of the Elections Commission was fruitless so I thank everyone for making themselves available on such short notice. The discussion yesterday centered around whether we were going to do the 4% increase for this position as we have done for other department heads or the 95% of the salary survey. The consensus was the 4% but we also addressed the car allowance which had not been changed since the position was created in 1999. The job has changed dramatically in that span of time and he does now handle multiple elections around the county.Also, we discussed the fact that the salary of this position – by State law – cannot exceed the salary of the County Clerk. What was not clear was if that meant that his position was always paid the same as the County Clerk – I have a problem with that because that is one Commissioners Court binding the proceeding years’ courts. So we elected to go with the 4% increase but also wanted to deal with car allowance.
Ms. Stewart: Judge, if I could clarify, the action the court just took previously on car allowances would also affect this position for a budget impact of $1100 because we already accounted for $1200 in the motion just made. So, it would be $1100 over and above the previous action.
Comm. White: Are we just considering the car allowance now or….
Ms. Stewart: The 4% is already included in action the court already took so, yes, we are just addressing car allowances.
Judge Horn: I was just trying to give you a little background regarding the discussion of the Election Commission. Their recommendation was for us to address the car allowance.
Comm. White: Can this come out of Contingency as well?
Comm. Mitchell: I am satisfied with the car allowance that we provided in our previous vote. I would not have voted on the car allowance that we got and I will not be voting favorably on this one either.7. LICENSE & WEIGHTS
Ms. Stewart: Agenda Item No. 6 needs clarification from court action taken last week on License & Weight. Vehicles and all other equipment in the License & Weight unit will be transferred to the Sheriff’s Department.
Comm. White: I thought I made that part of my motion.
Ms. Stewart: You did make that a part of your motion but, I believe, last week there was a request to transfer inventory from License & Weight to Constable Precinct Two. Beth had asked for some clarification on that issue.
Judge Horn: I requested that this be clarified so it is absolutely clear that everything assigned to License & Weights, prior to Commissioners Court last Tuesday, will be under Sheriff Elect Parkey effective January 1, 2005.7. B-4) Move to approve that the entire unit of License & Weights, including all personnel, equipment and inventory contained in this unit prior to Tuesday, August 10th, 2004, will be moved to the Sheriff’s Department effective January 1, 2005, by Judge Horn, seconded by Comm. White.

EMERGENCY MANAGEMENT COORDINATOR
Ms. Stewart: Included in your handouts today, I included a Budget Impact Statement based on the salary survey presented to court last week with a correction from Human Resources. Amy can address any of your questions but the impact of that is $4,320 to match the 95% of the Salary Survey Average for Collin and Ft. Bend Counties. Just so you are aware, this position will also receive the 4% increase on top of that.
Comm. Mitchell: Why?
Ms. Stewart: Because that was the action court had approved on the previous equity adjustments. So this $73,848 figure is based strictly on the 95% with the 4% being in addition to that.
Judge Horn: But the budget impact is still $4320, correct?
Ms. Stewart: Yes.
Comm. Mitchell: That is being fair and consistent but since I did not vote on the last one, I will be voting against this one. I did approve the 4% increase but not the 95%.
Comm. White: I did not support either – the 95% or the 4%. I believe there needs to be consistency regarding court’s action but I cannot support this.
Comm. Carter: We have to sometimes support decisions of the court even if we did not vote for a particular decision. I did not support the License & Weights unit being transferred to the Sheriff’s Department. But the court did. So it would not have made sense for me to vote against transferring the equipment just because I voted against transferring personnel. So you may not agree with the action but to be consistent, you must support the whole court’s action.
Comm. Mitchell: Comm. Carter has a good point and since this does not affect the tax rate, I will reconsider my position.
Comm. White: It is a good point but, of course, I think it would be more consistent for Comm. Mitchell to support this action since she did support the 4% and the 95% for department heads.
Comm. Mitchell: You are right…..you lucked out on this one, Jody.7.
