Be it remembered, Commissioners Court of Denton County, Texas was called to order at 4:00 PM on the 5th day of October, 2001 with Commissioner Bobbie J. Mitchell as Presiding Officer. Commissioners Jim Carter and Cynthia White were present, along with deputy clerk Kathleen Bransford.

ITEM 1 CALL TO ORDER

ITEM 2 EXECUTIVE SESSION

The Commissioners Court reserves the exercise of its discretion and may convene in executive session as authorized by the Texas Government Code Sections 551.071, et. seq. on any of the agenda items.
For purposes permitted by the Texas Government Code, Section 551.071- Contemplated or Pending Litigation or Settlement Offer, Section 551.072- Real Property, Section 551.074 -Personnel Matters and Section 551.076-Security.

Move to Convene in Executive Session by Comm. Carter, second by Comm. White.
Motion Carried 3-0-0

2.A) Consultation with attorney: settlement offer, Texas Government Code, Section 551.071(1)(B): Kim Creel, Individually, and on behalf of the Estate of Seth Moss, deceased.

Move by Comm. Carter, second by Comm. White to approve Settlement of a Claim brought by Kimberly Creel, individually, as Next Friend of Seth Moss and on behalf of the Estate of Seth Moss, deceased; authorizing the presiding County Judge to execute the Compromise Settlement Agreement; and authorizing the County Auditor and Treasurer to pay the sum of $100,000 from Emergency Contingency Funds.
