Be it remembered that Commissioners Court of Denton County, Texas, reconvened this 6th day of June, 2000, in a Public Hearing which the court recessed from February 1, 2000, concerning Agenda Number 3.A, on the creation of Denton County Development District #5.

ITEM 3 PUBLIC HEARING

3.A) Approve the creation of Denton County Development District #5 - Commissioners Court.

Mr. Frank Van Court presented the following documents to the Court for the record:

Mr. Don Blackwood, a partner in the proposed development, gave an overview of the project and
its ramifications.

Comm. Jacobs requested that Mr. Van Court read into the record the letter regarding the liabilities of a county development district.

Comm. Jacobs asked Mr. Van Court about the current population of Denton County. Mr. Van Court said that the population count refers to the last census of 1990.

Comm. Jacobs asked Mr. Blackwood the total value of this project. Mr. Blackwood replied that the project has gone from 300 million range to a conservative projection of one billion dollars.

Comm. Armey asked Mr. Blackwood if the City of The Colony is supportive of the process the court is taking on the CDD. Mr. Blackwood explained that the city is very supportive and moving forward on the annex/de-annex procedures.

Comm. Krueger praised this CDD as being the perfect form of how this state legislation is to be used properly and successfully.

Comm. Armey agreed that this is a tourist attraction because it is only one of three golf courses in the nation that replicates the courses in Scotland.

The City Manager of the City of The Colony, Lanny Lambert, apprised the court of the actions the city if taking to accommodate this CDD.

Bernetta Henville-Shannon from the City of The Colony expressed her concern about the city losing valuable property to the CDD in the de-annexation process and can a CDD support residences.

Richard Kuether from the City of The Colony also expressed his concerns regarding the de-annexation process and who is liable if the CDD fails.

Comm. Armey explained that a CDD cannot support residences alone but if they are a component tied to commercial development, then residences are allowed. Also, the liability will fall upon the investors who bought the bonds that underwrite the CDD.

Mr. Blackwood explained that a CDD finances a project that a city would not be able to finance or match the incentive programs that a CDD can.

Comm. Armey said the City of The Colony is responsible for the annex/de-annex process with the county's cooperation.

Comm. Krueger stressed the point that CDD funds cannot be used to build homes, only to build the infrastructure for those homes.

Mr. Van Court clarified the record on the fact that this district cannot have a confirmation election until it works out its relationship with the City of The Colony.

Comm. Armey praised the City of The Colony for the appointment of a committee, of which Comm. Krueger and himself have volunteered their time, to work out the details of their relationship to the CDD.
